Revised agency procedures issued to conform to election rule changes
The National Mediation Board issued a notice to carriers and unions on Monday, March 11 announcing changes to NMB election procedures pursuant to the agency’s December 2012 final rule, which revised representation election procedures. In response to amendments to the Railway Labor Act in the FAA Modernization Reform Act of 2012, the agency amended its existing regulations pertaining to representation elections, run-off elections, and rulemaking to reflect changes in statutory language. Significantly, the agency changed the showing of interest requirements in cases of mergers. The revised procedures issued this week reflect those changes.
The revised election manual also includes a provision requiring a carrier’s vice president of labor relations (or equivalent) to attest that the list of potential eligible voters provided to the NMB is accurate.
The modified election procedures will apply to all elections commencing on or after March 25, 2013.
